Business
is about relationships. A contract is more than a commitment to
buy
or sell
or to do or not do something. It is the creation of a
relationship. Business
runs
smoothly as long as the relationships do.
But,
sometimes, there is miscommunication and/or misunderstanding
and/or
a lack
of communication. The relationship breaks down. . . and so does
the
contract.
This
breakdown causes an increase in time and money for all
concerned. Each
party
must both try either to resolve the glitches in the old contract
(and
relationship) and/or, if this is not possible, to find new and
other sources
to keep
the business running. To do both at the same time takes time and
can
be
frustrating. It can also be expensive. Lawsuits cost money; and
there is no
guarantee of winning. Lawsuits do not look at the needs and
interests of the
people
but only who caused the contract to fall apart and was that
person
justified in doing so.
Mediation, on the other hand, does look at the needs and
interests of the
parties.
With the assistance of a mediator, the parties explore how to
resolve
the
dispute in a manner that is mutually satisfying. Many times,
such solutions
involve
things other than money. Thus, mediation is much more flexible
and
personable than a lawsuit: it is also much less time consuming:
which is what
business
is all about: running efficiently.
